DELHI HIGH COURT ORDERS REGISTRAR OF SOCIETIES TO LOOK INTO 'MISMANAGEMENT' OF DIGAMBAR JAIN TEMPLES
On the complaint of members of local Jain Panchayat, (Mohit Jain and Mayank Jain)  the Delhi High Court has ordered the Registrar of Societies, New Delhi to scrutinise the charges of mismanagement mentioned in the complaints of Digamber Jain temples in Delhi. Registrar is advised to check the petitioners' representation and pass necessary orders within a period of two months. The order is delivered by a Bench of Justice B A Khan and Justice B N Chaturvedi of Delhi High Court.
This order is delivered on the petition by two members of Pracheen Shri Aggarwal Digambar Jain Panchayat, which  alleged that the Registrar of Societies, who had issued notice to the Delhi Jain Panchayat in Aug. 2001 on their complaints, had failed to take any action. The executive committee of Panchayat controls several Jain temples in Delhi including Lal Mandir at Chandini Chowk which is also a heritage site. Complaint also mentions that inspite of representations to the Home Ministry, Lt Governor and Chief Minister, no action was taken by Delhi Jain Panchayat to hold elections.

The Delhi High Court refused to order for the appointment of an Administrator to Delhi Jain Panchayat since the entire matter at this stage is with the Registrar who can take appropriate action. The complaint alleges that executive of Delhi Jain Panchayat have not conducted the elections for last several years and misappropriated the funds of several crores of the organisation. It will be more appropriate for the entire Jain Samaj, if in future, we can resolve our differences and problems within the community without seeking outside support. Court battles not only create a bad taste among the members but also cause irreparable damage to the image of entire Jain Society.

A MIRACLE AT JAIN TEMPLE, FEELKHANA (HYDERABAD)
At Mahavir Swami Jain temple, Feelkhana in Hyderabad, a miracle took place in the early hours of the day. When the 'garbh-griha' (Sactum Sanctorium) of the temple was opened as usual at about 4 A.M., her Holiness Sadhwi Sulakshana Ji saw that a thick paste made up of sandalwood and saffron was pouring continuously from the head of the Mahavir's statue. She also saw that saffron water was coming out from the head of Dada Guru Jin Kushal Suri Ji. Miraculous phenomenon went on for 4 hours up to 8 A.M. The Trustees of the temple were immediately informed and the news spread over the entire area like fire and devotees and other people thronged the place for Darshan. The sadhwi ji later said that it was a good omen for the town and the entire State. Such miracles have happened elsewhere also in the recent past.

SUPREME COURT CLARIFIES THE MEANING OF 'RELIGIOUS MINORITY'
A prolonged controversy over the interpretation of the word, 'religious minority' came to a halt when the Supreme Court of India having a bench of 11 judges, headed by Chief Justice, B. N. Kirpal declared in its 320 page judgment that the decision about a state having any community being in religious community shall be taken on the basis of population of that community in that particular State and not on the basis of population of that community in the whole country. It also clarified that the Government can not exercise any control over such educational institutions which are not receiving any aid or grant from the Government. The minority community had a constitutional right to establish educational institutions of its own and 50 percent seats in such institutions could be earmarked for the students from that community but there should be complete transparency in the selection procedure.

Each of these visits were part of the Queen's Golden Jubilee Tour of the UK, their purpose being to demonstrate that Christian and non-Christian communities are central to contemporary Britain. During their visit, the Earl and Countess of Wessex were taken on a guided tour of Leicester's Jain temple which is the headquarters of Jain Samaj in Europe. The royal couple met the representatives of the Jain community, who then informed them about the main principles of Jainism, in particular the principle of non-violence. MAHARASHTRA, ANIMAL DEALERS CALL FOR GOVT. CRACKDOWN
Two years ago, Prime Minister Vajpayee directed state governments to strictly enforce animal transport and slaughter laws, but such enforcement is virtually impossible given the weak penalties under current law. Current law provides for a meagre fine of 10-50 rupees for first-time offenders convicted of cruelty to animals. In a report prepared by PETA, it is recommended to multiply that number by at least 100 and provisions for the confiscation of vehicles used to illegally transport animals and jail time for repeat offenders. The notable signatories to the report are Dr V.N. Vishnupurikar, general manager of the Deonar abattoir; Dr V.T. Raikwar, veterinarian at Deonar abattoir; Moin Quereshi, chairperson of the Cattle Dealers Association; M.A. Quereshi, president of the All India Sheep and Goat Breeder and Dealer Association; Dr P.M. Naik, livestock development officer and deputy director of animal husbandry; Dr H.D. Gaikwad, deputy director of Animal Husbandry; R.H. Kadam, deputy regional transport officer and Dr A.R. Nageshkar, secretary of the Bombay SPCA.

'Now that even the animal dealers and transporters and slaughter industries are calling for stiffer penalties for abusers, what is the Central Government waiting for?' asks PETA research manager Poorva Joshipura. 'The woefully inadequate Prevention of Cruelty to Animals Act of 1960 must be strengthened.' For more information, please visit www.PETAIndia.com.

GAIA ANIMAL PROTECTION ORG. (BELGIUM) TO APPEAL AGAINST RULING
The animal organisations GAIA and Animaux en Péril are shocked by the acquittal of the seven cattle dealers against whom the public prosecutor had initiated proceedings before the magistrate's court of Dinant on charges of serious ill treatment of animals at the Ciney cattle market. Once again, the judge did not rule on the substance of the case, namely cruelty against animals. He acquitted the cattle torturers, considering that the video footage could not be accepted as evidence and that it constituted an invasion of the privacy of the cattle dealers.

GAIA will appeal against this ruling, which once again sends the wrong message to cattle dealers, namely: "don't worry if visual proof of your misdeeds is submitted to the public prosecutor, you will not be found guilty anyway, for as always, it is your law of cruelty that prevails". Moreover, there is no legislation that specifically forbids pictures taken with a hidden camera to be used as evidence in court cases.

ARRESTED - MR. ARUN JAIN, CMD POLARIS SOFTWARE ARRESTED in INDONESIA
The chairman of Polaris group, Mr. Arun Jain, has been arrested by the Indonesian police over over a commercial dispute between his company and Artha Graha Bank in Jakarta. Mr. Jain was detained on December 13 on a complaint of the Bank which had signed a contract with Polaris and subsequently cancelled it. His arrest sent shock waves in the entire IT industry. The reaction was so sharp that a delegation of Nasscom called on IT minister Pramod Mahajan. The external affairs ministry also took the matter with the Indonesian ambassador and lodged a strong protest and demanded the release of Mr. Jain. The Polaris software had entered into and agreement with Bank Artha Graha in June and August of this year. The company claimed that the bank unilaterally terminated the contract, which was to be completed by July 2003. Polaris objected the termination and wanted to resolve the issue through talks. Mr. Jain went to Jakarta on December 13 to meet the bank officials at Jakarta and later arrested in the bank premises.

Sources from industry say there is a sinister story behind Mr. Jain's arrest. He went to Jakarta to settle the dispute. The bank asked Polaris to pay damages and return the advance. The bank started putting pressure on Mr. Jain to settle the dispute of payment before he could return to India. Mr. Jain requested time to consider the request. He was willing to consider this but the bank apparently asked for a "ridiculously large" amount. The bank, which has closed ties with the Indonesian military got Mr. Jain arrested. The entire Jain Samaj is both indignant and worried. Ahimsa Foundation requests all the Business leaders of Jain community around the world to come together and register a protest with the Indian and Indonesian Government.
